These Terms & Conditions govern your access to and use of the Dr. Kisha Birden website, content, products, programs, events, services, and related platforms operated by Birdens Lifted LLC.

Specific services may also be governed by a separate agreement, proposal, invoice, event policy, purchase agreement, or statement of work. When a separate written agreement applies, that agreement will control if it conflicts with these general Terms.

3. Educational and Wellness Disclaimer

All information, content, programs, publications, events, and services provided by Birdens Lifted LLC and Dr. Kisha Birden are intended for educational, inspirational, and personal-development purposes only.

They are not intended to serve as:

  • Medical or mental-health treatment
  • Therapy, counseling, or crisis intervention
  • Diagnosis or treatment of any condition
  • Legal advice

5. Orders and Payment Terms

All prices are listed in United States dollars unless otherwise stated.

Payment is due in full at the time of purchase unless an approved payment plan or separate written agreement has been provided.

By submitting payment information, you authorize Birdens Lifted LLC and its approved payment processors to charge your selected payment method for:

  • The stated purchase amount
  • Applicable taxes
  • Shipping and handling charges
  • Processing fees disclosed before purchase
  • Installment payments included in an approved payment plan

You are responsible for maintaining accurate billing and contact information.

We reserve the right to correct pricing errors, reject suspected fraudulent transactions, limit quantities, or cancel orders when a product, service, or event was listed incorrectly. If an order is canceled after payment has been processed, the applicable amount will be refunded.

6. Payment Plans

When a payment plan is offered, you agree to complete every scheduled payment according to the terms presented at checkout or in your written agreement.

A payment plan represents a commitment to pay the full purchase price. It is not a month-to-month subscription that may be canceled at any time.

Failure to complete scheduled payments may result in:

  • Suspension of access
  • Removal from a program or event
  • Cancellation of remaining services
  • Withholding of deliverables
  • Collection activity where legally permitted
  • Additional fees disclosed in the applicable agreement

Suspension or termination due to nonpayment does not automatically eliminate the outstanding balance.

7. Refunds and Final Sales

Except where otherwise stated in writing or required by applicable law, all purchases are final.

Because customers may receive immediate access to educational content, intellectual property, digital materials, reserved event seating, professional time, customized services, or downloadable resources, refunds are generally not provided for:

  • Digital products and downloads
  • Books, journals, and publications
  • Consulting or professional services
  • Completed speaking engagements
  • Workshops, courses, or programs
  • Event registrations
  • Deposits and retainers
  • Customized or personalized products
  • Merchandise marked as final sale
  • Services already rendered or initiated

The inability to attend an event, complete a program, access content because of personal technology issues, or fully use a purchased resource does not automatically create a right to a refund.

Nothing in this section limits any nonwaivable consumer rights or cancellation rights provided under applicable law.

8. Physical Products and Merchandise

Product descriptions, photographs, colors, dimensions, and other details are provided as accurately as reasonably possible. Minor variations may occur due to production processes, materials, printing, photography, lighting, screen settings, or product updates.

Customers are responsible for reviewing product descriptions, measurements, sizing information, shipping details, and care instructions before placing an order.

Claims involving an incorrect, damaged, or defective physical item must be submitted to DrKisha@DrKishaBirden.com within seven calendar days of confirmed delivery. The claim should include:

  • The customer’s name
  • The order number
  • A description of the issue
  • Clear photographs of the item and packaging

We may offer a replacement, store credit, refund, or other appropriate resolution after reviewing the claim.

Items that have been worn, washed, altered, used, damaged after delivery, or returned without authorization may not qualify for replacement or refund.

9. Shipping and Delivery

Shipping and delivery estimates are provided for convenience and are not guaranteed unless expressly confirmed in writing.

Birdens Lifted LLC is not responsible for delays caused by:

  • Postal carriers or shipping companies
  • Severe weather or natural disasters
  • Incorrect or incomplete addresses
  • Customs or governmental processing
  • Labor interruptions
  • Supply-chain issues
  • Events beyond our reasonable control

Customers are responsible for providing a complete and accurate shipping address. Additional shipping charges may apply when an order must be resent because of an incorrect address, refused delivery, or failure to retrieve a package.

Risk of loss may transfer to the purchaser when an order is delivered to the shipping carrier, subject to applicable law and carrier policies.

10. Events and Experiences

Registration requirements, schedules, locations, speakers, activities, and program details may vary by event.

Birdens Lifted LLC reserves the right to make reasonable changes to:

  • Event schedules
  • Speakers or facilitators
  • Locations or venues
  • Session formats
  • Activities
  • Program content
  • Virtual platforms

These changes do not automatically entitle registrants to a refund.

If Birdens Lifted LLC cancels an event and does not provide a rescheduled date, comparable replacement experience, or transferable credit, affected registrants will receive instructions regarding the available resolution.

Birdens Lifted LLC is not responsible for personal travel, lodging, meals, transportation, childcare, lost wages, or other expenses incurred in connection with an event.

Participation may be denied or discontinued without refund when an attendee engages in threatening, discriminatory, abusive, disruptive, unlawful, or unsafe behavior.

11. Event Photography and Recording

Events, programs, workshops, and experiences may be photographed, filmed, livestreamed, or recorded.

Unless prohibited by law or expressly stated otherwise, attendance at an event may constitute consent for Birdens Lifted LLC to use photographs, video recordings, audio recordings, or other media containing your image, voice, appearance, or participation for legitimate business, educational, archival, and promotional purposes.

When a separate release or consent form is provided, the terms of that document will apply.

Attendees may not record private sessions, confidential discussions, copyrighted presentations, or other participants without prior authorization.

12. Intellectual Property

All website content, publications, frameworks, presentations, courses, recordings, graphics, photographs, videos, audio materials, downloads, event concepts, written materials, and other intellectual property provided by Birdens Lifted LLC or Dr. Kisha Birden are owned by or licensed to Birdens Lifted LLC.

Protected materials include, but are not limited to:

  • The Cry Code™
  • Cry Like A Girl!™
  • The Cry Room Experience™
  • Books, journals, and written publications
  • Emotional-intelligence and leadership frameworks
  • Workshop and presentation materials
  • Event concepts and experiences
  • Digital products and educational resources
  • Brand names, logos, slogans, and visual materials
  • Recorded, streamed, and downloadable content

Purchasing or accessing content does not transfer ownership of the intellectual property to you.

Unless written permission is provided, you may not:

  • Copy, reproduce, republish, or distribute materials
  • Sell, license, sublicense, or commercially exploit materials
  • Upload materials to shared platforms or artificial-intelligence systems
  • Share login credentials or restricted content
  • Record paid programs or presentations
  • Remove copyright, trademark, or ownership notices
  • Create derivative programs, courses, books, events, or frameworks
  • Present our materials as your own
  • Use our names, trademarks, or content in a misleading manner

Materials purchased for individual use may be used only by the original purchaser for personal, educational, or internal professional-development purposes.

13. User Submissions

You retain ownership of original content you voluntarily submit through the website, social platforms, testimonials, surveys, event activities, or other interactive features.

By intentionally submitting content for publication, promotion, or public display, you grant Birdens Lifted LLC a nonexclusive, royalty-free, worldwide license to use, reproduce, edit, display, and distribute that content for the purpose for which it was submitted.

We will not knowingly publish private or sensitive personal information as a testimonial without appropriate permission.

You may not submit content that:

15. Confidentiality

Certain consulting relationships, private sessions, programs, or group experiences may include confidential, proprietary, personal, or sensitive information.

Participants agree not to disclose or misuse:

  • Another participant’s personal information

  • Nonpublic recordings or communications

Birdens Lifted LLC will use reasonable care when handling information shared during private services. However, confidentiality cannot be absolutely guaranteed in public events, group programs, online platforms, social-media discussions, or circumstances involving third-party technology.

Nothing in these Terms creates a legally privileged relationship.

16. Personal Responsibility

You remain responsible for your own choices, actions, health, relationships, business decisions, professional decisions, and personal well-being.

Participation in a program, event, workshop, course, or service does not transfer responsibility for your decisions to Birdens Lifted LLC or Dr. Kisha Birden.

You agree to exercise independent judgment and seek qualified professional assistance when appropriate.

17. No Guarantees

Birdens Lifted LLC and Dr. Kisha Birden do not guarantee specific personal, emotional, professional, financial, leadership, business, healing, or life outcomes.

Results vary based on many factors, including:

  • Prior experience
  • Health and wellness needs
  • Professional support
  • Market and economic conditions
  • External circumstances beyond our control

Testimonials and examples are illustrative and should not be interpreted as promises or guarantees.

To the fullest extent permitted by law, Birdens Lifted LLC, Dr. Kisha Birden, and their owners, employees, contractors, representatives, speakers, volunteers, and affiliates will not be liable for:

Nothing in these Terms excludes liability that cannot legally be excluded or limited.

22. Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless Birdens Lifted LLC, Dr. Kisha Birden, and their employees, contractors, representatives, and affiliates from claims, damages, liabilities, losses, and reasonable expenses arising from:

23. Chargebacks and Payment Disputes

Customers are encouraged to contact Birdens Lifted LLC directly before initiating a chargeback or payment dispute so that reasonable efforts can be made to resolve the concern.

Fraudulent, abusive, or knowingly false payment disputes may result in:

  • Immediate suspension of access
  • Cancellation of services

  • Collection of unpaid balances
  • Submission of relevant transaction records to the payment provider
  • Legal action where appropriate

This provision does not prevent a customer from exercising legitimate rights available through a bank, card issuer, payment processor, or applicable law.

24. Termination of Access or Services

Termination resulting from a violation does not automatically create a right to a refund.

Provisions concerning payment obligations, intellectual property, confidentiality, liability, indemnification, and dispute resolution will survive termination.

25. Privacy

Your use of the website and services is also governed by the Birdens Lifted LLC Privacy Policy.

We do not sell or rent personal information.

When reasonably possible, we may offer a rescheduled date, alternative delivery method, replacement experience, transfer, or credit.

These Terms & Conditions are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to conflict-of-law principles.

29. Dispute Resolution

Before filing a legal claim, the parties agree to make a good-faith effort to resolve the dispute through direct written communication.

The person raising the dispute should provide written notice describing:

  • The nature of the dispute
  • The relevant purchase or service
  • The requested resolution
  • Supporting information reasonably necessary to evaluate the concern

If the dispute cannot be resolved through direct communication, the parties agree to consider good-faith mediation before pursuing litigation, unless immediate legal relief is reasonably necessary or mediation is prohibited by law.

Any legal action that is not resolved through informal negotiation or mediation must be filed in a court of competent jurisdiction serving Dauphin County, Pennsylvania, unless applicable law requires another venue.

30. Severability

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or removed as necessary.

The remaining provisions will remain in effect.

31. No Waiver

Failure by Birdens Lifted LLC to enforce a provision of these Terms does not waive the right to enforce that provision or any other provision in the future.

32. Entire Agreement

These Terms, together with the Privacy Policy and any applicable purchase agreement, event policy, proposal, invoice, or service agreement, constitute the agreement between you and Birdens Lifted LLC concerning your use of the applicable website, product, or service.

33. Updates to These Terms

Birdens Lifted LLC reserves the right to modify these Terms & Conditions when necessary to reflect changes in services, business practices, technology, or legal requirements.

The updated effective date will be displayed at the top of this page.

Continued use of the website, products, or services after updated Terms are posted constitutes acceptance of those changes to the extent permitted by law.
